Thank you for using this Site, which is owned by Homesteaders Life Company or a subsidiary of Homesteaders. These Terms of Use govern your use of platforms on which it is posted that are owned by Homesteaders and its subsidiaries.

Definitions

The term “Content” refers to all of the software and code comprising or used to operate this Site, and all of the text, photographs, images, illustrations, graphics, sound recordings, video and audio-video clips, and other materials available on this Site, including User-Generated Content and Feedback.

The terms “Homesteaders” refers to Homesteaders Life Company.

The terms “we,” “us,” and “our” refer to Homesteaders and any subsidiary of Homesteaders.

The term “Feedback” refers to the Content you post on or through this Site that is specifically about how we can improve this Site and the products and services we make available through this Site.

The term “including” means “including, but not limited to.”

The term “Site” refers to any platform owned by Homesteaders Life Company, on which these Terms of Use are posted, including our main website www.homesteaderslife.com.

Your Acceptance of These Terms of Use

Please take a few minutes to review these Terms of Use before using this Site. By using this Site or consenting to participate in our calling, texting, and/or email marketing, you are agreeing to comply with and be bound by these Terms of Use. If you do not agree to these Terms of Use, you may not access or use this Site or consent to participate in our calling, texting, and/or email marketing.

Calling, Texting, and Email Terms

If a form is part of this Site, by completing the form on this Site, including providing your telephone number, checking the consent box, and clicking “SUBMIT”, you consent to receive periodic marketing telephone calls and/or recurring text messages, including from an automatic telephone dialing system or using a prerecorded message or artificial voice from Homesteaders and/or any Participating Funeral home and any related affiliates or third parties calling on our behalf at the telephone number(s) you provided, including your mobile telephone number(s).

If you would like to receive telephone calls and/or text messages, you must opt in as described above. You may consent for us to contact you via telephone call and text message, or telephone call only (no texts.) Your consent is not required as a condition of purchasing any goods or services or receiving any information from Homesteaders or a Participating Funeral Home.

With your consent to receive text messages, you understand that you are responsible for all charges and fees associated with text messages that may be imposed by your mobile carrier. Standard message and data rates may apply.

You agree you are the owner or assigned user of the telephone number you provide. You agree you have provided us with a valid mobile or residential telephone number. If you change your mobile or residential telephone number, you agree to notify us immediately, and opt out of all marketing telephone calls and text messages prior to changing your telephone number.

To ensure that a customer’s inquiries are handled promptly, courteously, and accurately, some of the telephone calls between you and us or any of our affiliates, agents, assigns and service providers, may be monitored and recorded by us and any of our affiliates, agents, and service providers, to enhance service to you. You expressly consent to this monitoring and recording by using this Site.

You further agree that we may send email messages to you at any email address you provide to us or use other electronic means of communication to the extent permitted by law.

Your consent for telephone calls, text messages, and/or email messages may be revoked at any time and by any reasonable means, including providing notice by emailing us at help@efuneral.com, by calling us at 515.305.2500 or by visiting our website at https://efuneral.com/contact/.

To opt out of text messages, you may also reply “STOP” to a text message from us. You will receive a one-time opt-out confirmation text message. After that, you will not receive any future messages.

At any time, you may receive support regarding our text messages to you by replying “HELP” to a text message from us. Please note that replying “HELP” will not opt you out of receiving text messages. You may stop receiving our text messages as described above.

 

Ownership of this Site and its Content

This Site, including all its Content, are protected under applicable intellectual property and other laws, including without limitation the laws of the United States and other countries. All Content and intellectual property rights therein are the property of Homesteaders and/or its subsidiary or the material is included with the permission of the rights owner and is protected pursuant to applicable copyright and trademark laws.

The presence of any Content on this Site does not constitute a waiver of any right in such Content. You do not acquire ownership rights to any such Content viewed through this Site. Except as otherwise provided herein, none of this Content may be used, copied, reproduced, distributed, republished, downloaded, modified, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without our express prior written permission.

Permission is hereby granted to the extent necessary to lawfully access and use this Site and to display, download, or print portions of this Site on a temporary basis and for your personal, educational, noncommercial use only, provided that you (i) do not modify the Content; (ii) you retain any and all copyright and other proprietary notices contained in the Content; and (iii) you do not copy or post the Content on any network computer or broadcast the Content in any media.

Homesteaders and any Participating Funeral Home shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, advertising, services, products, or other materials on or available from such websites. These Terms of Use do not apply to your use of third-party websites; your use of such websites is subject to the terms and policies of the owner of such websites.

Modification and Discontinuation

We reserve the right at any time and from time-to-time to modify, edit, delete, suspend or discontinue, temporarily or permanently this Site (or any portion thereof) and/or the information, materials, products and/or services available through this Site (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any such modification, editing, deletion, suspension or discontinuance of this Site.

Waiver

Our failure at any time to require performance of any provision of these Terms of Use or to exercise any right provided for herein will not be deemed a waiver of such provision or such right. All waivers must be in writing. Unless the written waiver contains an express statement to the contrary, no waiver by Homesteaders of any breach of any provision of these Terms of Use or of any right provided for herein will be construed as a waiver of any continuing or succeeding breach of such provision, a waiver of the provision itself, or a waiver of any right under these Terms of Use.

Severability

If any provision of these Terms of Use is held by a court of competent jurisdiction to be contrary to law, such provision will be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of these Terms of Use will remain in full force and effect.

ARBITRATION AGREEMENT WITH CLASS ACTION WAIVER

Mandatory Binding Individual Arbitration. Except as expressly provided below, any dispute, claim, case, or controversy (whether based in tort, contract, statute, regulation, ordinance, equity or any other legal theory) between you and us (whether arising out of or relating to past, present or future acts or omissions) (“Claims”) shall be exclusively resolved by binding arbitration on an individual basis, rather than in court (“Arbitration Agreement”).

Waiver of Class Actions. Each party will assert Claims in arbitration only in our individual capacity, and not as a representative or member of any purported class. We each agree that we will not participate in any class, mass, collective, consolidated, private attorney general or other representative arbitration proceeding. The arbitrator has no authority to arbitrate Claims on a class-wide basis and shall not consolidate, combine, or jointly arbitrate Claims of more than one person in a single arbitration.

Waiver of Jury Trial. Each party waives its constitutional and statutory rights to go to court and have a trial in front of a judge or a jury, electing instead to resolve by binding arbitration all Claims.

Opt-out. You may opt out of this Arbitration Agreement if you send us a signed, written opt-out notice within thirty (30) days of your initial visit to the Services. Any opt-out notice shall be sent to: Homesteaders Life Company, 5700 Westown Parkway, West Des Moines, IA 50266.

Small Claims Not Subject to Arbitration. Any party may bring individual Claims in small claims court.

Arbitration Procedures. Any party may initiate an arbitration proceeding, which will be conducted by a single neutral arbitrator.

Arbitration Provider. Any party will initiate arbitration before JAMS, Inc. (“JAMS”) or any successor to JAMS, which is an alternative dispute resolution provider (“ADR Provider”). In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then any party can elect to have the arbitration administered by another mutually agreeable arbitration administration service who will hear the case.

Arbitration Rules. The arbitration will be conducted under the JAMS Streamlined Arbitration Rules and Procedures (available at www.jamsadr.com) (“Arbitration Rules”). The rules of the ADR Provider will govern all aspects of the arbitration, except to the extent such rules are in conflict with this Arbitration Agreement.

Arbitration Location. If an in-person hearing is required, then it will take place in Minneapolis, MN, Chicago, IL, Atlanta, GA or Dallas, TX (whichever is closest to your residence), unless the claimant primarily resides outside the United States (in which case the arbitrator will give the parties reasonable notice of the date, time and place of any oral hearings).

Fees. Payment of all filing, administrative, and arbitrator fees will be governed by the Arbitration Rules.

Arbitrator’s Authority and Award. The arbitrator will decide the rights and liabilities, if any, of the parties, and the dispute will not be consolidated with any other matters or joined with any other cases or parties. The arbitrator will have the authority to grant motions dispositive of all or part of any Claim. The arbitrator will have the authority to award monetary damages, and to grant any non-monetary remedy or relief available to an individual under applicable law, the ADR Provider’s Rules, and this Arbitration Agreement. The arbitrator will issue a written award and reasoned statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded. The arbitrator has the same authority to award relief on an individual basis that a judge in a court of law would have. Any award will be subject to judicial confirmation or entry in any court having jurisdiction.

Governing Law. This Arbitration Agreement is governed by the Federal Arbitration Act and federal arbitration law.

Confidentiality. All aspects of the arbitration proceeding, including but not limited to, the award of the arbitrator and compliance therewith, will be strictly confidential. The parties agree to maintain confidentiality unless otherwise required by law. This paragraph will not prevent a party from submitting to a court of law any information necessary to enforce this Arbitration Agreement or to enforce an arbitration award.

 

Governing Law, Jurisdiction and Venue

These Terms of Use will be governed under the laws of the State of Iowa without regard to its conflicts of law provisions. For any dispute that is not subject to the Arbitration Agreement herein, all actions or proceedings arising out of or relating to these Terms of Use will be venued exclusively in state or federal court in the City of Des Moines, in Polk County, Iowa. You hereby irrevocably consent and submit to the personal jurisdiction of said courts for all such purposes. However, we retain the right to bring legal proceedings in any jurisdiction where we believe that infringement of these Terms of Use is taking place or originating.

 

Indemnity

You shall indemnify and hold Homesteaders, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of this Site in violation of these Terms of Use and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or if any material that you post using this Site causes us to be liable to another. We reserve the right to defend any such claim, and you agree to provide us with such reasonable cooperation and information as we may request.

You shall indemnify and hold any Participating Funeral Home, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of this Site in violation of these Terms of Use and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or if any material that you post using this Site causes us to be liable to another. We reserve the right to defend any such claim, and you agree to provide us with such reasonable cooperation and information as we may request.

 

Entire Agreement

These Terms of Use (together with our Privacy Policy and any Privacy Notices or click-through agreements applicable to you) contain the entire understanding and agreement between you and Homesteaders with respect to this Site and supersede all previous communications, negotiations, and agreements, whether oral, written, or electronic, between you and Homesteaders with respect to this Site and your use of this Site.

 

Dealings with Third Party Merchants

If you choose to correspond, participate in a promotion or engage in transactions with any merchant found on or through this Site, you acknowledge that Homesteaders is not a party to, and will not be responsible for, your interaction with such merchant, including its treatment of your information and the terms and conditions applicable to any transaction between you and the merchant. The terms of your interaction with any merchant are solely between you and such merchant. Homesteaders will have no responsibility or liability for any loss or damage of any kind that you may suffer as the result of any such interaction or the presence of such merchants on this Site
